My own tiny role in Canada's biggest free speech case ever

If you haven't heard, my article here might have caused a bit of legal trouble for myself and the Tribune. I was inspired (and outraged) after I read Mark Steyn's article that was reprinted in the Gazette. At the same time, I had been doing research for a sidebar about Bill C-10 funding restrictions and the history of media censorship in Canada. What I found was a disturbing pattern -- an illiberal crusade on the part of minorities to shut out unpleasant ideas using Canadian law. I wrote this up in the aforementioned op-ed, and waited. I purposely didn't feature lawyer and activist Richard Warman very prominently -- knowing that others have had trouble with him.

Luckily, Mr. Warman is competent with Google and found the article anyway, calling up the Tribune, and sending a threatening e-mail, saying my article potentially libeled and defamed him.


The following elements of the article are libelous of
me:
i) the article falsely describes my human rights work
and then links it to “crypto-fascism”;
ii) the article wrongly asserts that I filed a human
rights complaint against David Icke;
iii) the article wrongly asserts that I am the
complainant in almost 50% of all Canadian human rights
cases; and,
iv) the article wrongly asserts that my concerns about
David Icke’s connections with the dissemination of
anti-semitic material are false and based upon his
theories about extra-terrestrials.


In his defense, two of those are true. I did accidently mistranslate Mark Steyn's words about being a plaintiff in 50% of all section 13 federal cases to "50% of all human rights cases." Also, he did not file a human rights complaint against Icke, just petitioned to have his books removed from libraries across the West. That was sloppy of me.

At the same time, he requested "that the McGill Tribune remove this article immediately from your website. Further, that a full retraction and apology in language to be agreed from Mr. Tau and the Tribune appear in the next hard-copy edition of the Tribune with the same prominence and location of the original article. Also, that this same retraction and apology be placed in perpetuity on the Tribune's website in place of the original article. Lastly, that the Tribune issue DMCA notices to all others reposting the article in order to prevent further dissemination of the libel."

Luckily, the Trib editors have a bit of sense. The accidental mis-information will be corrected; the article itself will not be taken down. But there's a larger fight here. The Globe and Mail has a pretty good editorial about the matter, and Rick Mercer has a pretty good rant. Ezra Levant is still being sued (but not by Richard Warman) in a human rights court, and Canadians still don't have any meaningful right to express controversial ideas, because of an illiberal censorship regime of political correctness.

Few Americans even know this is going on. Canada is not an autocratic country by any means -- but at the same time, its got a long way to go to be the truly liberal oasis that it often proclaims itself to be. Tolerance breeds tolerance, responsibility breeds responsibility and censorship breeds seething discontent. Canada has state-imposed censorship with it comes to such things. Its time for anti-liberal shenanigans like this to end.

You seem like a smart kid, Tau; and you are right. I'm glad your editors back you in snickering at this litigation-gnome Richard Warman, a neurotic zealot who can't even do his own bullying without government assistance...

Typos seem to have attacked your last few sentences, tho. I am not sure how responsibility breads responsibility, unless responsibility is a fish stick. And to end your post with "its like for this to end" seems inconclusive, at a minimum. -- Cheers, Earnest Canuck, vancouver.

You are a most astute young man. I am elated to see someone in the current pedantic meat grinder who thinks outside the PC box and "gets it".

The forces driving group identity politics (under the sanitizing banner of multiculturalism and Human rights) and the politically correct thought and expression cleansing regimens are NOT liberal.

As you state, the very essence of their mission and mindset is "illiberal".

I'm a classic Liberal and I think these people are statist thugs. From my perspective, the Liberal party abandoned both me and liberal ideals when it was permeated with a new left element who espoused, as you call them, crypto-fascist methods and ideals.

There are certainly elements of crypto-fascism in their methods and motives. They have a morbid need to control, force political/ideological conformity and censor dissent. No doubt this mindset would be enamored of the single party police state and commissariats which control political/ideological deviance.

I admire you for being accountable, and admitting your small mistakes.

However, encouraging people to throw a pie in Icke's face could be understood as the metaphorical equivalent of launching a "human rights" complaint, under Canada's crypto-fascist Section 13.

And the larger issue here is one of competing narratives. The avatars of the "human rights" industry in this country are basically scared of free-wheeling political speech, basically afraid that any and all politics creates victims, the sundry losers in debates and conclusions (and democratically-determined actions therefrom) over what is and is not publicly, ethically, acceptable. And they believe in building legal codes to minimize or eliminate all kinds of victimization. The courts and the semi-hidden tribunal must trump open politics.

In the wake of postmodern thinking, all they know of politics is about contesting too much political freedom, which they imagine is largely in the service of the rich and powerful and knowledgeable, i.e. in service of "the normal", they allege consiratorially. So, all they know of politics is about contesting the conspiracy of the normal (all of people's received and local loyalties, as well as their freedom) and its supposedly inevitable creation of victims. And they are no less against the Western, Judeo-Christian normal when it is advancing the cause of human freedom in face of tribal codes. White racism they will put on trial, but black or Arab racism?
Haven't seen that yet. (But Bob Rae's wife is a Jew...)

So, instead of allowing someone like Ezra Levant to get away with publishing cartoons that throw light on the return of fascism to Europe, or allowing Mark Steyn to quote the tribal fanatics and their desires for Europe, they would prefer we come to no such conclusions, that we not debate, that we just give up our freedom to top-down opinion control of politically-correct elites. Freedom is what the "human rights" industry today fears most.

In other words the "human rights" industry pretends to be demanding personal accountability of those they tag with "hate crimes" while being part and parcel of a system that systematically erodes public accountability by replacing properly political arenas and free speech with moral and legal codes that demand you button your mouth.

When Mr. Warman's friends in the Canadian Jewish Congress support him in free-wheeling public debate with the real force for antisemitism in this country - the left-Liberal-Islamofascist alliance - or, when they are open and honest with a Royal Commission, or with free and accountable journalists, about all the methods and tactics they have used as "human rights" investigators - I will say they are being as accountable as you.

But, when they claim, again and again, the victim (defending) role, I will just ask: but what about your victims? Do you really think you have created none? And how can we properly weigh the balance, without free speech? It is no accident that those who make a career out of victimary politics, out of using the state to control against too much freedom, are afraid of a free and full accounting. They rightly demand it of others, but think it an outrage when others ask it of them. For they have done no wrong. Couldn't have. They're the righteous, the defenders of victims and human rights. They only throw bad guys under the bus. Really. You know the guys in the black hats. Black hats! Nazis! Get it?!

The true journalist will respond to Mr. Warman's letters by calmly and carefully investigating all the claims made against him on the internet, and now in the mainstream media. They will seek to know the truth and hold the reputations of liars and hate mongers publicly accountable. Ezra Levant and Mark Steyn say they are trying to do this, but are they blinded by personal animus? How good a job are they doing?

The more freely-given iterations of that question and answers we have, the better and freer our country will be. And there is a special place in heaven for friends of Canada who help us in the task. Yet in defending the freedom of political debate in one nation, we are defending it in all. For the real enemy fancies itself some kind of post-political, pro-(international) law, trans-national progressivism.

If there are young people like yourself in the higher education - people who can think for themselves instead of being indoctrinated, people who are not easily bullied, people who can express themselves eloquently in writing - then there is hope for our country and our civilization yet.

Kid I hate to break it to you, but you are not "the one". You are going to have to chose between this fight, and living your life.

Your opponent has a $100k plus cushy job at DND and can spend all day dreaming up ways to make your life a living hell. The Canadian Human Rights "star chamber" will use taxpayer money to handle ALL of his legal fees, filings, detective work against you, everything. Over time you will have to get on with making a living.

Unless you manage to also get inserted into the Federal Government job for life / no work matrix, you will eventually succumb to the endless litigation.

Face it kid, you've been living in a dream world. It's time to grow up. There are two types of Canadians, the people work work all day and the civil servants. Furthermore, unless you fit into one of the designated "politically correct" groups, or are French, your chances of becoming a "chosen one" civil servant are lower than your opponent's belly...

No shut up, apologize and start working at some $50K a year job so that our $100k a year civil servants can take their sick days and go on vacation to Cuba.

(Ahem, in my opinion) this sting also shows Lucy to be an incompetent fool, since his (ahem, in my opinion) bullying is having the opposite of its desired effect.

Your student newspaper has a circulation of 11,000 (according to Wikipedia), I can’t imagine many more go to the paper’s website, so maybe a max of 25,000 (and probably significantly fewer) people might have seen your op-ed, many of them sympathetic to Lucy (it being primarily a university audience).

Until Lucy fired off his email (I wonder if he has an automated program, where bots find mention of his name, cut-and-paste the specific allegations into a form email, and send it while he sleeps, dreaming of a utopia where citizens won’t have their hopes and dreams crushed by the likes of David Icke). Now that your op-ed and blog has been linked to by Ezra Levant, far more people have and will see it than had it stayed confined to your campus. (Ahem, in my opinion) nice work, Lucy!

Oh, and I’ve also been given the idea of actively googling to look for more blogs that are chronicling this sitcom (and it’s a helluva lot more entertaining than Scrubs), an idea I most certainly would not have ever come up with had I not followed Ezra’s link to this blog. (Ahem, in my opinion) nice work, Lucy!

btw, I’m an American and your HRCs, and the cases against Levant and MacLeans, are getting some sporadic press down here. Keep up the good fight.

And I also want to take this opportunity to thank Canada for, over the years, providing such great entertainment for my enjoyment. I’m sure I will always fondly remember John Candy, Dan Akroyd, and Richard Warman. Thank you, Canada.

Thousands of bloggers in Canada the U.S. and around the world are now hep to exactly how warman and his corrupt CHRC thought-police buddies intimidate ordinary citizens. They are all just bullies who censor and oppress innocent Canadians similar to the way the Taliban oppressed Afghanistanis.

Keep up the good work. Help us restore for Canadians their most fundamental human right: Freedom of Expression

I also heard he was a member of a homosexual activist group and a member of a Zionofascist-Jewish lobby group who is aligned with Communists. If true, that would make this Warman pansy my least favorite Canadian.

His oppression of free expression is a sign of fascist-like ideals. I had no idea someone could sue you for claiming you're a fascist. Maybe people should start suing Warman for being a Fascist-like Communist?

The word on the street is that Ezra Levant is seeking info on Dicky Warman. Give ALL info you have to him, Mr. Tau.

Also, I know it seems out of place, but may I ask what race you are?

The name appears to be Asian but I may be incorrect. If so, you'd be the first non-White, non-Jewish person to get a complaint from Warman that I am aware of.

Nice to see you not caving in to this loon. I am an American and I have been hearing bits and pieces about this story for a few months now due to Michelle Malkin's blog being a daily stop for me. It's no stretch to think that some of this type of thing could very easily creep in to America, we don't have anything national like the CHRC- yet. But I am waiting for the announcement anytime now.

Myself and millions of Americans are aware, watching and support your efforts to insure free speech. I will be posting about this on my blog, hard reset, later today.

I am totally surpised and encouraged that such a relevant article appears in a McGill University paper.

I go to Concordia and am regularily repulsed by the school newspapers and their politically correct fascism. I have felt so isolated as I listen to barrages of this sort of brainwash regularily in class.

Cheers to you for being one of the few to pave the way for the future, and to fight against these injustices that have become the law of the land.

i am an (east) indian, watching from faraway with interest the valiant efforts of your HRCs. i have seen the curious case of mr ezra levant, and how the commissions are suddenly finding him to be within his limits even when he provocatively republished the views of the priest mr. boisson. it will not be proper for a foreigner to call your HRCs names, but i can call you a courageous youth, youth upon who your country can build its future. you are far more sensible than the HRCs. i wont blame them, in these difficult times, for attempting to manufacture some work for themselves so that they could continue to exist. but you DO have a future, believe me. you are serving your country in a far better manner.
